RCRA and CERCLA Provisions

Although LANL is a designated RCRA facility and is not on the National Priorities List, DOE guidance specifies that LANL must conform to CERCLA requirements to the extent possible. DOE guidance resulting from Executive Order (EO) 12580, Superfund Implementation, leads to the following interpretation:

• CERCLA applies if hazardous substances are released into the environment or if a substantial threat of release exists.
• CERCLA specifies that the remediation requirement applies in equal fashion to federal and nonfederal entities.
