State Statutes
The following state statutes can affect LANL's Remediation Services project:
- Air Quality Control Act of 1967. Provides the basic framework for
air pollution control in New Mexico.
- Groundwater Protection Act of 1990. Provides for the regulation of
hazards associated with leaks and spills from underground storage tanks,
containment and remediation of pollution incidents, and funding of groundwater
protection activities.
- Hazardous Chemicals Information Act of 1990. Establishes state-level
systems for emergency planning and notification concerning releases
of extremely hazardous substances. Also provides a way to inform the
public about hazardous chemicals used in their communities and releases
of those chemicals.
- Hazardous Waste Act of 1977, as amended. Establishes the State of
New Mexico's program for hazardous waste management and control. Because
this act meets federal requirements, EPA has authorized the state to
regulate site closures under RCRA.
- Radiation Protection Act of 1978. Establishes the general rule of
radiation protection. Specifies that levels of radiation must be kept
as low as reasonably achievable, taking into account the state of technology
and the costs of improvements in relation to (1) public health and safety
benefits, and (2) the use of ionizing radiation in the public interest.
- Radioactive and Hazardous Materials Act of 1990. Regulates the transportation
of radioactive material on highways. It requires use of means of transportation
that protect the health, safety, and welfare of the citizens and includes
criteria for establishing the safest route.
- Solid Waste Act of 1990. Establishes a comprehensive statewide solid
waste management program to regulate the reduction, storage, collection,
transportation, separation, processing, recycling, and disposal of solid
waste and to promote source reduction, recycling, reuse, treatment,
and transformation of solid waste.
- Water Quality Act of 1990. Gives the New Mexico Oil Conservation
Division exclusive authority over the prevention of water pollution
resulting from oil or gas operations.
